The Minnesota Department of Natural Resources, Lands and Minerals Division is seeking to fill one (1) full-time Attorney 1 or Attorney 2 position.
This position is responsible for assisting in managing legal issues assigned by the Division of Lands and Minerals Director, Assistant Director, or Legal Unit Supervisor. It will assist with ethical, responsive, and effective legal expertise and services to the Division of Lands and Minerals and assists with agency-wide legal expertise and services in the areas of real estate and minerals law. Responsibilities include but are not limited to:
Drafting orders to resolve claims for the value of mineral rights filed with the Department under recently enacted tax forfeiture provisions.
Assisting with the public sale of metallic mineral, industrial mineral, and gas leases, the development of lease terms and conditions, and the issuance of metallic mineral, industrial mineral, and gas leases through negotiation or public sale.
Conducting mineral title research to discover state-owned minerals.
Assisting with the preparation of documents for non-registered severed mineral forfeiture actions.
Advising the agency on real estate transactions such as acquisitions, leases, and easements.
Researching and interpreting federal and state laws, regulations, local ordinances and court cases to advise and direct the agency to ensure that programs and policies are administered in compliance with applicable laws and regulations.
This position has a flexible work arrangement and may be eligible to telework on a part-time basis which is subject to change. If approved, the employee would be required to complete an annual telework agreement.
Minimum Qualifications
Attorney 1:
Current licensure in good standing to practice law in the State of Minnesota.
Must have a Juris Doctorate (J.D.)
One (1) year of professional experience practicing law.
Ability to research, understand, interpret and explain relevant law, and apply it in complex legal and factual settings.
Ability to speak and write effectively, including drafting clear, concise and well-reasoned findings of fact, conclusions and orders.
Ability to produce high quality legal writing, with appropriate analysis and using proper citation form.
Ability to relate and communicate effectively with individuals who do not share the same culture, ethnicity, language or other common experiences.
Attorney 2:
Must have a Juris Doctorate (J.D.)
Current licensure in good standing to practice law in the State of Minnesota.
Three (3) years of professional experience practicing law including two years of practice in the area of real estate law or mineral law.
Demonstrated human relations and communication skills, effective writing, listening, persuasion and ability to develop consensus among diverse interests in an objective and fair manner.
Problem solving skills sufficient to define, understand, analyze, prioritize, and recommend solutions to complex problems related to operations, policy, and program priorities.
Demonstrated ability to develop and maintain effective working relationships with a wide variety of clientele, both internal and external to the Division and Department.
Ability to produce written products that are thorough in content and professional in appearance.
Preferred Qualifications
Experience drafting mineral leases, including leases for taconite, nonferrous metallic minerals, or oil and gas.
Experience researching mineral title.
Experience drafting agency or local government orders and advising agencies or local governments regarding substantive and procedural requirements.
Additional Requirements
This position requires an unrestricted Class D Driver's license with a clear driving record.
